1. About Everyday Lux PerksEveryday Lux Perks (referred to in these Terms as "we", "us" or "our") is a family lifestyle loyalty and rewards club operated by Teagan Treloar and Emma Power, trading as Everyday Lux Perks (ABN: 52101061355), based in Queensland, Australia.
These Terms and Conditions ("Terms") govern your access to and use of the Everyday Lux Perks website, membership program, promotional draws, discount partner portal, and any other services we offer (collectively, the "Services").
By purchasing a membership, one-off entry package, accessing our website, or otherwise engaging with our Services, you agree to be bound by these Terms in full. If you do not agree with any part of these Terms, you must not use our Services.
We reserve the right to update these Terms at any time. Changes will be published on our website at https://everydayluxperks.com and will take effect immediately upon publication. Your continued use of the Services following any update constitutes your acceptance of the revised Terms.

2. Eligibility
To become a member of Everyday Lux Perks and to be eligible to enter any of our promotional draws, you must meet all of the following eligibility criteria:
You must be an Australian resident aged 18 years or older
You must provide accurate and complete personal information at the time of registration
You must maintain a valid payment method for subscription members
You must not be an employee, contractor, director, or immediate family member of Everyday Lux Perks, or any of our brand partners
Residents of South Australia are not eligible to enter any promotional draws conducted by Everyday Lux Perks due to the regulatory requirements of that state.
South Australian residents may still purchase a membership and access the member discount portal, but will not be entered into any giveaway draws.
By purchasing a membership or entry package, South Australian residents acknowledge and accept this limitation.
We reserve the right to verify the eligibility of any member or entrant at any time and to disqualify any person who does not meet the eligibility criteria.

3. Membership
3.1 Membership Tiers

Everyday Lux Perks offers the following membership tiers.
All prices are in Australian dollars (AUD) and are inclusive of GST where applicable:

This is a limited “founding member” offer available for the first 60 days only. The price is locked in for as long as the subscription remains active.

Everyday Tier – $7.99 per month
Includes 1 entry per month.
This is the standard entry-level subscription.

Lux Tier – $24.99 per month
Includes 5 entries per month.
Also includes early draw access and bonus entries for birthdays.

Icon Tier – $79.99 per month
Includes 25 entries per month.
Includes first access to draws, birthday bonus entries, access to Icon-only draws, and merchandise discounts.

Single Entry (one-off) – $9.99
Includes 1 entry.
Provides 30 days of portal access, valid for the current draw only.

Bonus Pack (one-off) – $29.99
Includes 10 entries.
Provides 30 days of portal access, valid for the current draw only.

3.2 What Membership Includes

All membership tiers — both subscription and one-off packages — include the following as genuine member benefits, not as entry fees into any promotional draw:Access to the Everyday Lux Perks member discount portal for the duration of your membership or access periodAccess to exclusive member-only flash drawsOne entry per billing period into The Family Giveback drawMember entries into our current promotional draw(s) as specified in your chosen tier — these entries are provided as an inclusion with your membership purchase and are not the subject of any charge
Additional tier-specific benefits are as described on our website at the time of purchase. We reserve the right to update tier inclusions with reasonable notice to members.

3.3 Entry Structure

Everyday Lux Perks operates as a Category 4 Promotional Game under Queensland's Charitable and Non-Profit Gaming Act 1999 and relevant regulations. In accordance with these requirements, entry into all promotional draws conducted by Everyday Lux Perks is included in your membership cost. Your membership fee is charged in exchange for access to genuine membership benefits including the member discount portal and other inclusions. The promotional draw entries included with your membership are provided at no additional cost and constitute a free inclusion.
No additional fee is charged at any point for entry into a draw. If you wish to enter into a giveaway without becoming a member, a single entry method is available by purchasing a single one off OR a bonus one off membership giving you 30 days once off access. These entries will receive the minimum number of free entries into the giveaway equivalent to the paid tier. 

3.4 Founding Member Tier

The Founding Member tier at $4.99 per month is available for a limited time during our launch period only. The availability window will be clearly advertised on our website and social media channels. Once the Founding Member window closes, this tier will no longer be available to new members.
Members who join during the Founding Member window and maintain a continuous active subscription will retain the $4.99 price permanently while Everyday Lux Perks is operating. If a Founding Member cancels their subscription at any time, the $4.99 price will not be available upon resubscription and the member will be required to join at the standard Everyday tier pricing or above.

3.5 Accumulating Entries

Subscription members accumulate additional entries with every month they remain continuously subscribed. The number of entries accumulated each month corresponds to the entries included in the member's chosen tier. Accumulated entries are applied to all draws active during the month in which they are earned.
Accumulated entries are forfeited if a subscription is cancelled. Entries do not carry over or transfer between subscription tiers. If a member upgrades their tier, accumulation resets based on the new tier's monthly entry allocation from the date of upgrade.

3.6 Subscription Billing and Cancellation

Subscription memberships are billed monthly in advance on the date of sign-up. All payments are processed securely via Stripe. By subscribing, you authorise us to charge your nominated payment method on a recurring monthly basis until cancellation.
You may cancel your subscription at any time via your account dashboard or by emailing us at [INSERT EMAIL ADDRESS]. Cancellation will take effect at the end of the current billing period. No refunds are provided for partial billing periods. Access to membership benefits continues until the end of the paid period following cancellation.
We reserve the right to suspend or cancel a membership at any time if payment cannot be processed, if a member is found to have breached these Terms, or if we reasonably suspect fraudulent activity.

3.7 One-Off Packages

One-off packages provide access to the member discount portal for the specified access period and entries into the current draw at the time of purchase. One-off package entries do not accumulate and are not carried forward to future draws. Portal access expires at the end of the stated access period regardless of whether it has been used.
One-off packages are non-refundable once purchased. If a draw is cancelled or postponed after purchase, entries will be transferred to the next available draw.

4. Promotional Draws

4.1 Draw Structure

Everyday Lux Perks conducts promotional draws on a regular basis. Each draw will have its own specific terms including the prize description, draw date, entry cap (where applicable), and eligibility. These specific terms will be published on our website and social media channels prior to entries opening for that draw.
Where a draw is capped at a maximum number of entrants, the draw will close once that cap is reached or on the advertised closing date, whichever occurs first. We will announce when a draw is approaching capacity through our social media channels.

4.2 Draw Conduct

All promotional draws are conducted using a government-approved random electronic number generator via randomdraws.com.au, operated by TPAL Australia. Draws are broadcast live on our official Instagram account. The draw process is as follows:All valid entries are assigned a unique entry number prior to the drawThe random draw is conducted live on Instagram using randomdraws.com.auThe winning entry number is announced publicly during the live drawThe winner is contacted by Everyday Lux Perks within 24 hours of the draw via the phone number or email address provided at registrationIf the winner cannot be contacted within 5 business days of the draw, a redraw will be conducted and the original winner forfeits their prizeResults are published on our website and social media channels within 48 hours of the draw

4.3 Prizes

Prize descriptions, values and conditions are as advertised for each individual draw. Prize values are based on recommended retail prices at the time of advertising. Where a prize includes a cash alternative, the winner must elect either the prize or the cash alternative at the time of being notified — no changes can be made after election.
Prizes are non-transferable, cannot be exchanged for any other prize, and cannot be redeemed for cash except where a cash alternative is explicitly offered as part of that draw. Prize images used in promotional materials are for illustrative purposes and may not represent the exact item provided.
The following prize types are excluded from all Everyday Lux Perks draws in compliance with Queensland legislation and Australian Consumer Law:Tobacco products or related itemsFirearms, weapons, ammunition or explosivesCosmetic or surgical proceduresAny item whose sale or supply is restricted or prohibited by Australian law
Where a prize involves a motor vehicle, the prize includes standard dealer delivery, registration, compulsory third party insurance, and GST unless otherwise specified. All vehicle prizes are ex-Queensland. The winner is responsible for any stamp duty, on-road costs, or other charges not explicitly included in the prize description.

4.4 The Family Giveback

The Family Giveback is a monthly community initiative conducted by Everyday Lux Perks, separate from our standard promotional draws. All active members — regardless of tier — receive one entry into The Family Giveback draw each month. The Family Giveback may take the form of a grocery payment, bill payment, fuel card, or similar household benefit, as determined by Everyday Lux Perks each month.
The Family Giveback is not a promotional draw for the purposes of trade promotion lottery legislation. It is a discretionary community initiative conducted at the sole discretion of Everyday Lux Perks. We reserve the right to alter the format, value, or frequency of The Family Giveback at any time without notice.

4.5 Icon-Only and Member-Only Draws

Certain draws are restricted to specific membership tiers as advertised. Icon-only draws are open only to active Icon tier subscribers. Member-only flash draws are open to all active subscription members. One-off package holders may or may not be eligible for tier-specific draws as stated in the relevant draw terms.

4.6 Draw Cancellation or Amendment

We reserve the right to cancel, postpone, or amend any draw at any time. In the event of a cancellation, all entries will be transferred to the next equivalent draw or, where no equivalent draw is planned, a full refund will be provided to one-off package purchasers. Subscription members will not be entitled to a refund for draw cancellations as membership fees are charged for the full suite of membership benefits, not for any individual draw.

5. Member Discount Portal

Access to the member discount portal is a core benefit of all Everyday Lux Perks memberships. The portal provides access to exclusive discount codes and offers from our approved brand partners.
Discounts available through the portal are provided by our brand partners and are subject to each partner's own terms and conditions. We do not guarantee the availability, accuracy, or value of any partner discount at any time. Partner arrangements may change and discounts may be added or removed from the portal without notice.
Member discount codes are for personal use only. Sharing, distributing, or publishing member discount codes outside of the member portal is strictly prohibited and may result in immediate cancellation of membership without refund.
We are not responsible for any transactions, disputes, or issues arising between members and brand partners. Any concerns regarding partner products or services should be directed to the relevant brand partner directly.

6. Birthday Bonus Entries

Lux and Icon tier members receive bonus entries in their birthday month as follows:Lux members receive double their standard monthly entries in the calendar month of their registered birthdayIcon members receive five times their standard monthly entries in the calendar month of their registered birthday
Birthday bonuses are applied automatically based on the date of birth provided at registration. It is the member's responsibility to ensure their date of birth is accurate in their account profile. Birthday bonuses cannot be applied retrospectively, transferred to another month, or claimed for a previous period. Birthday bonuses are not available to Founding Member or Everyday tier subscribers.

7. Founding Icon Badge

The first one hundred (100) members to subscribe to the Icon tier will receive a permanent Founding Icon badge on their member profile. This badge is a recognition of early support and carries no additional monetary value or additional entries beyond the standard Icon tier inclusions.
The Founding Icon badge is non-transferable and will remain on the member's profile for the duration of their active membership. If an Icon member cancels their subscription, the Founding Icon badge is forfeited and will not be reinstated upon resubscription, regardless of availability.

8. Member Conduct

All members are expected to engage with Everyday Lux Perks and our community in a respectful and lawful manner. The following conduct is strictly prohibited and may result in immediate termination of membership without refund:Providing false, misleading, or fraudulent information at any pointAttempting to manipulate, interfere with, or influence any promotional drawCreating multiple accounts to obtain additional entriesSharing, selling, or transferring membership access or discount codes to third partiesHarassing, threatening, or engaging in abusive behaviour toward Everyday Lux Perks staff, partners, or other members on any platformPublicly disparaging Everyday Lux Perks, its founders, members, or brand partners in a manner that is false, defamatory, or intended to cause harmAny conduct that we reasonably determine to be harmful to the reputation or operation of Everyday Lux Perks

9. Privacy and Personal Information

Everyday Lux Perks collects personal information including your name, address, email address, phone number, date of birth, and payment details for the purpose of operating our membership program, processing payments, contacting winners, and communicating with members about our Services.
We handle all personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles. We will never sell your personal information to third parties. We may share your information with our payment processor (Stripe), our draw provider (TPAL Australia via randomdraws.com.au), and our email marketing provider, solely for the purpose of operating our Services.
By becoming a member, you consent to receiving communications from Everyday Lux Perks including draw announcements, winner notifications, member updates, and promotional content. You may unsubscribe from marketing communications at any time by using the unsubscribe link in any email or by contacting us at everydayluxperks@gmail.com Transactional communications related to your membership cannot be opted out of while your membership is active.
Winner names and general locations (first name and state) may be published on our website and social media channels following a draw. By entering any draw, you consent to this limited publication of your details. We will never publish your full address, phone number, or financial details publicly.

10. Intellectual Property

All content on the Everyday Lux Perks website and social media channels — including but not limited to the brand name, logo, graphics, photographs, written content, and promotional materials — is the intellectual property of Everyday Lux Perks and is protected by Australian copyright law.
You may not reproduce, distribute, modify, or use any of our intellectual property without our prior written consent. Members may share our promotional content on personal social media accounts for the purpose of promoting our draws, provided appropriate credit is given and the content is not altered.

11. Limitation of Liability

To the maximum extent permitted by Australian law, Everyday Lux Perks and its operators are not liable for any direct, indirect, incidental, special, or consequential loss or damage arising from:Your use of or inability to access our website or ServicesAny errors, inaccuracies, or omissions in our website contentAny interruption, suspension, or termination of our ServicesAny issues arising from transactions between members and brand partnersAny technical failures affecting draw entry processing
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

12. South Australian Residents

Due to the regulatory requirements of the South Australian lottery and gaming legislation, residents of South Australia are not eligible to participate in any promotional draw conducted by Everyday Lux Perks. South Australian residents may purchase a membership solely for the purpose of accessing the member discount portal. No refund will be provided to South Australian residents on the basis of draw ineligibility as the membership fee is charged for the full suite of membership benefits of which the discount portal forms a genuine and material part.

13. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of our Services will be subject to the exclusive jurisdiction of the courts of Queensland. These Terms must be read in conjunction with all applicable Australian Consumer Law, the Privacy Act 1988 (Cth), the Charitable and Non-Profit Gaming Act 1999 (QLD), and any other relevant Australian legislation.
